1. Introduction
These Terms and Conditions govern your use of the services provided by SA Jumping Castles ("we," "us," or "our"). By booking our services, you agree to be bound by these Terms and Conditions.
2. Services Offered
We provide rental of jumping castles, including delivery, setup, and takedown services.
3. Booking Process
Bookings can be made via phone and email. We may offer online booking in the future. Your booking is considered final upon confirmation.
4. Payment Policy
Full payment is required to secure your booking. Payment must be received in full at the time of booking.
5. Cancellation, Refund, and Rescheduling Policy
Once a jumping castle is booked, cancellations are not permitted. Postponements are allowed only if requested at least 14 days prior to the scheduled booking date. The only exceptions are in the event of the death or illness of the person who booked or the person whose birthday it is, provided that proof is supplied. In the case of a reschedule, the new booking must be made within one year from the original booking date.
6. Usage Terms and Safety Rules
Standard safety guidelines apply to the use of our jumping castles. These include:
- Ensuring that children are always supervised by a responsible adult.
- Adhering to any age or weight restrictions specified for the equipment (typically, jumping castles are intended for children aged 3-12 years).
- Following all instructions provided by SA Jumping Castles regarding the safe use of the equipment.
By booking a jumping castle, you automatically waive and release SA Jumping Castles from any liability for injuries, accidents, or misuse of the equipment.
7. Liability and Damages
SA Jumping Castles covers damages arising from usual wear and tear. However, if damage occurs due to negligence or malicious intent, the renter will be invoiced for the cost of repairs. As the jumping castle is used outside our direct control, the renter assumes full responsibility for safety, injuries, accidents, and misuse.
8. Additional Fees or Charges
There are no additional fees for late returns, extra services, or special event conditions unless otherwise agreed upon in writing.
9. Dispute Resolution and Governing Law
These Terms and Conditions are governed by the laws of South Africa. Any disputes or claims arising from these Terms and Conditions shall be resolved in the courts located in Gauteng, South Africa. We encourage you to contact us directly to resolve any issues amicably before pursuing legal action.
10. Force Majeure and Changes in Service
SA Jumping Castles is not liable for delays or failure to perform due to circumstances beyond our control, including but not limited to extreme weather, natural disasters, or other unforeseen events. In such cases, we reserve the right to reschedule the service at a mutually agreed time.
11. Changes to Terms and Conditions
We reserve the right to modify these Terms and Conditions at any time. Any changes will be posted on our website, and your continued use of our services constitutes acceptance of the updated terms.
